Why form a BVI Trust?

  • The law is specific in determining the law which shall govern trust in cases of conflict of laws.
  • There are specific provisions in the law with regard to the law which shall govern a trust in case there is a "forced heirship" provision in the law of the settlor.
  • The only tax imposed on a BVI trust is a US$50.00 revenue stamp called "the trust duty" which must be affixed to the instrument creating the trust.
  • A trust may be revoked or amended only to the exception and in the manner especially stated in the trust instrument.
  • A BVI trust may include provisions in which a person has the power to supervise or approve all of the trustee's actions (Protector).
  • BVI trusts are not subject to public registry. Therefore, confidentiality is achieved.
  • A trust may be constituted depending on the particular needs of the clients; it is a perfect vehicle for asset protection and family estate planning.
